Para conocer la realidad actual de las Sociedades Financieras de Objetivo Múltiple Entidades No Reguladas (SOFOM ENR), respecto a la aplicación de la Normativa que la Comisión Nacional de Defensa de los Usuarios de Servicios Financieros (CONDUSEF) y la Comisión Nacional Bancaria y de Valores (CNBV), en el presente trabajo se dan conocer los procedimientos y los objetivos que las SOFOMES implementan en su actuar diario; además, no solo se verterá la información, sino que se explora la mejora en los procedimientos de implementación de dichas normas y se busca la forma de disminuir las irregularidades que muy frecuentemente incurre por la falta de comprensión y conocimientos. Por la complejidad y delicadeza de las faltas que las SOFOMES ENR cometen en ésta área, se ha convertido para ellas en un cuello de botella, mismo que ha crecido a la par con el crecimiento del mercado financiero no bancario. Se detalla de forma sencilla los procedimientos y requisitos para implementar dichas normas; además, del contexto alrededor del tema de lavado de dinero que la CNBV retoma para supervisar a las SOFOMES ENR. Se dará un análisis de resultados de las diversas supervisiones de los últimos años que ha realizado la CNBV y la CONDUSEF a estas instituciones y algunas sugerencias que puedan ayudar a las SOFOMES ENR a aplicar de manera más idónea la normatividad actual. _______________ IMPLEMENTATION OF THE CONDUSEF AND CNBV NORMS TO A FINANCIAL ENTITY WITH A NON-REGULATIVE MULTIPLE OBJECTIVE. ABSTRACT: To know the actual reality of the Financial Holding of Multiple Object, Non-Regulated Entity (SOFOM ENR). In respect to the application of the Normativity that the National Commission of Defense of the Users of Financial Services (CONDUSEF) and the Banking and Value National Commission (CNBV). This document shows the procedures and goals of the SOFOMES implemented in their daily performance. Also, not just giving the information, but exploring the improvement of the procedures of implementation of the regulations as it searches for a way to reduce the irregularities that incur, due to not having the complete understanding and knowledge. Due to the complexity and the delicacy of the flaws that the SOMES ENR commits in these areas, this has turned into a bottleneck for them. This has grown at the same time with the non-banking financial market. It is detailed, in an easy manner, the procedures and requirements for the implementation of the norms; besides the context surrounding money laundering which the CNBV does to supervise the SOFOMES ENR. An analysis of the results will be given, of the different supervisions of the last years that the CNBV and CONDUSEF have done to these institutions, and of the suggestions that can assist the SOFOMES ENR to apply the actual regulation in a better way.
