GETTING AWAY WITH ROBBERY? PATENTING BEHAVIOR WITH THE THREAT OF INFRINGEMENT AgEcon
Yiannaka, Amalia; Fulton, Murray E..
The paper examines jointly the decision to patent, the optimal patent breadth decision and how these decisions affect, and are affected by, the innovator's ability to enforce her patent rights. A key result is that patenting may occur even when invoking an infringement trial is not profitable for the innovator.

The Canadian Wheat Board in an Open Market: The Impact of Removing the Single-Desk Selling Powers AgEcon
Fulton, Murray E..
Over the summer and early autumn of 2006, the Government of Canada has indicated its desire to remove the single-desk selling powers of the Canadian Wheat Board (CWB). The purpose of this paper is to explore the impacts of this proposal. The main conclusion of the paper is that it will be very difficult, if not impossible, for the CWB to survive as an organization. Thus, contrary to what the recent task force report by the federal government indicates, the most likely impact of removing the single-desk selling powers is that the CWB will cease to exist. The elimination of the CWB would transform the Canadian grains industry, with the impact of this change felt in virtually every part of the system. The changes that would accompany the loss of...

The Economic Impact of Non-Compliance in the Carbon-Offset Market AgEcon
Fulton, Murray E.; Mihal, Daniela.
Carbon offset markets have been suggested as a cost effective means of reducing GHG emissions. This paper develops a model of heterogeneous emitters and producers to examine the consequences of non-compliance on the performance of the carbon-offset market. The analysis begins with the derivation of demand and supply curves for carbon offsets based on perfect compliance. The paper then considers the impact of non-compliance by producers on the supply of carbon offsets. Results show that the extent of producers' non-compliance decreases with an increase in the audit probability and/or an increase in the penalty per unit of non-compliance. In addition, the number of producers participating in the carbon offsets market is shown to increase with an increase in...

THE PROVISION OF RAIL SERVICE: THE IMPACT OF COMPETITION AgEcon
Fulton, Murray E.; Gray, Richard S..
Grain transportation is one of the most important economic issues for grain producers in the Northern Plains. The reliance on export markets and the long distances to port position means that transportation costs have a significant effect on the price received by farmers. In the prairie region of Canada, rail transportation is undergoing a major transformation that will affect the competitive positions of agriculture in both the United States and Canada and influence the direction of grain flows between the two countries. Rail rates are no longer legislated although a cap is still in place), restrictions on branch line abandonment have been lifted, and further deregulation of price and car allocation is being considered. Some parties, including the...

INNOVATION ACTIVITY IN A MIXED OLIGOPOLY: THE ROLE OF CO-OPERATIVES AgEcon
Giannakas, Konstantinos; Fulton, Murray E..
This paper develops a sequential game theoretic model of heterogeneous producers to examine the effect of co-operative involvement on innovation activity in the agricultural input-supplying sector. Analytical results show that the co-operative involvement in R&D can be welfare enhancing and, thus, socially desirable. The presence of the co-op can increase the arrival rate of innovations and productivity growth while reducing the prices of agricultural inputs. The effectiveness of the co-op is determined by the size of R&D costs.

Greenhouse Gas Policy and Canadian Agriculture AgEcon
Fulton, Murray E.; Cule, Monika; Weersink, Alfons.
To meet its commitment to the Kyoto Protocol (KP), Canada must reduce its current annual GHG emissions (694 MT CO2 equivalent) by 240 MT CO2. Canada’s agricultural industries have the potential to generate a carbon sink of 10 MT CO2 (Government of Canada, 2003). The purpose of this article is to consider the manner in which Canadian agricultural policy has responded to Canada’s KP commitment and the likelihood that Canadian agriculture will participate significantly in carbon emission trading.

STRATEGIC PATENT BREADTH FOR DRASTIC PRODUCT INNOVATIONS AgEcon
Yiannaka, Amalia; Fulton, Murray E..
The paper models the patenting behavior of the innovator/patent applicant who having invented a drastic product innovation decides on the optimal breadth of protection claimed. The patenting process is modeled as a sequential game of complete information. The patentee acts strategically and with foresight. He chooses the breadth of protection that induces the desired behavior by his opponents and he incorporates transaction costs that may have to be incurred to enforce his patent rights. Our results suggest that contrary to what is traditionally assumed it is not generally optimal for the patentee to claim the broadest protection possible.

The Role of Cooperatives in Communities: Examples from Saskatchewan AgEcon
Fulton, Murray E.; Ketilson, Lou Hammond.
This paper examines the role of cooperatives in the economic and social development of communities in Saskatchewan, a prairie province of Canada. Based on a comprehensive study of cooperatives in that province, it provides statistical evidence of the economic importance of cooperatives and anecdotal evidence from interview that demonstrates the value of cooperatives in contributing to the social well-being of residents and in maintaining a sense of community. It also posits a number of theoretical models that can be used to explain the role of cooperatives in communities. A major finding is that cooperatives play a critical role in ensuing the continued social and economic existence of many communities, particularly smaller communities facing rural decline.

The Restructuring of the Saskatchewan Wheat Pool: Overconfidence and Agency AgEcon
Fulton, Murray E.; Larson, Kathy A..
This paper examines how agency problems combined with overconfidence and hubris by coop management lead to financial failure in the Saskatchewan Wheat Pool. As a consequence of both of these problems, the Pool made poor investment decisions and ended up in severe financial difficulties. These problems were exacerbated by three additional factors: (1) ownership and control were separated via an A-B share structure, leading to a situation where neither farmer members nor investors had an incentive to monitor management activities; (2) the sheer volume of investment activity undertaken made it virtually impossible for the board to stay on top of what was happening; and (3) as a result of the change financial structure, senior management had available a large...

PATENT BREADTH AS AN ENTRY DETERRENT: THE CASE OF VERTICALLY DIFFERENTIATED PRODUCT INNOVATIONS AgEcon
Yiannaka, Amalia; Fulton, Murray E..
Patents provide very important incentives for innovative activity by enabling innovators to appropriate innovation rents through the granting of exclusive rights on their innovations. The limit of these exclusive rights is defined by two elements - patent length and patent breadth. Patent length is the time period during which the innovator has exclusive rights on the innovation and is predetermined by law. Patent breadth defines the technological territory claimed and protected by the patent - the area in the technological space within which competitors cannot offer rival innovations without infringing the patent - and is explicitly chosen by the innovator. A standard assumption in the economics literature is that an innovator should always choose to...

The (Bargaining) Power of Incentives: Cooperatives, For-Profit Firms and the Cost of Procurement AgEcon
Bontems, Philippe; Fulton, Murray E..
In this paper, we show formally that cooperatives can possess an informational - and hence cost - advantage compared to For Profit Firms. This advantage is directly linked to the goal alignment between the cooperative and its members, and is influenced by the extent of income redistribution between members. Hence the standard practice of modeling the cooperative and the FPF as having identical cost structures appears to be theoretically unsound.
