The paper examines jointly the decision to patent, the optimal patent breadth decision and how these decisions affect, and are affected by, the innovator's ability to enforce her patent rights. A key result is that patenting may occur even when invoking an infringement trial is not profitable for the innovator.

The market acceptance and welfare impacts of genetic use restriction technologies (GURTS) AgEcon

The paper develops a theoretical framework of heterogeneous consumers and producers to examine the market and welfare effects of the introduction of variety-level genetic use restriction technologies (V-GURTs) under the current No-Labeling regime of GMPs in the US market. AGRICULTURAL BIOTECHNOLOGY AND ORGANIC AGRICULTURE: NATIONAL ORGANIC STANDARDS, LABELING AND SECOND-GENERATION OF GM PRODUCTS AgEcon

This paper examines the effect of the introduction of labels for products of biotechnology on the markets for GM, conventional, and organic food products. In addition, the paper analyzes the market and welfare effects of the introduction of consumer-oriented, second-generation GM products. Analytical results show that while a no-labeling regime is generally beneficial for the organic sector, when segregation costs are sufficiently high the introduction of labels for GM products can enhance the consumption share and growth of the organic sector while driving the conventional products out of the market. STRATEGIC PATENT BREADTH FOR DRASTIC PRODUCT INNOVATIONS AgEcon

The paper models the patenting behavior of the innovator/patent applicant who having invented a drastic product innovation decides on the optimal breadth of protection claimed. The patenting process is modeled as a sequential game of complete information. The patentee acts strategically and with foresight. He chooses the breadth of protection that induces the desired behavior by his opponents and he incorporates transaction costs that may have to be incurred to enforce his patent rights. Our results suggest that contrary to what is traditionally assumed it is not generally optimal for the patentee to claim the broadest protection possible.

Patents provide very important incentives for innovative activity by enabling innovators to appropriate innovation rents through the granting of exclusive rights on their innovations. The limit of these exclusive rights is defined by two elements - patent length and patent breadth. This study develops a theoretical framework of heterogeneous consumer preferences to examine the effect of voluntary and mandatory country of origin labeling (COOL) on consumer purchasing decisions and welfare when consumers view COOL information as an attribute that differentiates products vertically and horizontally. Analytical results of both the vertically and horizontally differentiated product models show that the change from a no COOL to a mandatory COOL regime decreases (increases) the welfare of consumers with weak (strong) preference for COOL. Innovating firms choose to patent their innovations when patenting allows the appropriation of more rents than do other forms of intellectual property protection (e.g., trade secrecy). The level of innovation rents that can be captured by the patent is mainly determined by the breadth of patent protection. Thus, once the decision to patent has been made, the innovator needs to make another important decision, namely, how broad of a patent protection to claim. Strategic Licensing of Product Innovations AgEcon

Obtaining a patent provides the patentee with the ability to offer a potential entrant a license to operate within the patent that has been claimed. This paper shows that the patentee always has an incentive to provide a license if the patentee is unable to use patent breadth to deter entry (if the patentee can deter entry, it is optimal for the patentee to do so). Licensing a new product to a competitor has two benefits for the patentee. First, licensing creates an incentive for the entrant to select the product location that maximizes the joint profits of both it and the patentee, rather than just its own profits. The paper examines the relationship between the innovator's patenting and patent breadth decisions as well as how these two decisions affect, and are affected by, the innovator's ability to enforce her patent rights. An important feature of the model is that the entrant may be able, by his choice of location in product space, to affect the innovator's decision to defend her patent. An interesting finding of the paper is that the innovator might find it optimal to patent her innovation even when she chooses to not defend her patent by invoking a trial when patent infringement occurs.
