The Common Agricultural Policy (CAP) was strongly criticized for the food safety crises of the 1990s which included Bovine Spongiform Encephalopathy (BSE), dioxin, foot and mouth disease and swine fever to name a few. Even though the first rules on food safety date from the very early days of the EU, a need was recognized to replace a number of these rules accumulated through the years, whose implementation was difficult to monitor, with a simpler and more comprehensive approach. The result was the General Food Law (REGULATION (EC) No 178/2002). Agri-environmental schemes (AES) have been studied under different perspectives in Europe, since the beginning of the ‘90s. Under regulation 1698/2005, agri-environmental schemes design has been modified with a more clear identification of a baseline for identifying the commitments and the costs of these prescriptions. The link between cross-compliance and agri-environmental schemes can be interpreted as a problem of joint design by the decision maker. From the farmer’s point of view, private costs of participations in agri-environmental schemes shall be added to the cost to be compliant with the mandatory standard defined for each measure if they are not already implemented. The Common European Agricultural Policy (CAP) reform not only has an impact on agriculture but also has significant effects on nature and the environment. This is specifically caused by decoupling direct payments from agricultural production, which will increase the market orientation of agriculture, and the implementation of Cross Compliance. Based on an empirical analysis of the consequences of the CAP reform in eight German regions, a number of key aspects for a future environmentally friendly development of the agrarian policy are suggested.
